These Terms of Service govern your use of www.neweranutrition.fitness and any purchase you make from New Era Nutrition.

Using our site

You agree to use the site lawfully and not to interfere with its operation or security. Content, branding, and design are owned by New Era Nutrition and may not be copied without permission.

Orders & pricing

• Placing an order is an offer to buy; we may accept or decline (e.g., if an item is out of stock or a price was listed in error).
• Prices, deals, and availability can change at any time. Applicable sales tax is added at checkout.
• Pickup orders are held at our McFarland store; you'll be notified when your order is ready.

New Era Rewards

Rewards points have no cash value, are tied to your phone number, are not transferable, and the program may be modified or discontinued at any time. Points are a promotional benefit, not property.

Gift cards

Gift cards do not expire and carry no dormancy, service, or inactivity fees. Under California Civil Code §1749.5, a gift card with a remaining balance under $10 may be redeemed for cash at our McFarland store. Gift cards are non-reloadable unless stated otherwise. Changes to the Rewards program do not affect a gift card that has already been sold.

We describe products as accurately as possible but do not warrant that all information is error-free. Dietary supplements are not a substitute for professional medical advice. Consult a physician before use, especially if pregnant, nursing, taking medication, or managing a medical condition.

Warranty disclaimer

Except where prohibited by law, the site and products are provided "as is" and we disclaim all implied warranties, including implied warranties of merchantability and fitness for a particular purpose. Nothing here limits a manufacturer's warranty on a product you buy from us, or any right you have under California consumer law.

Limitation of liability

To the fullest extent permitted by law, New Era Nutrition is not liable for indirect or consequential damages arising from your use of the site or products. Our total liability for any claim is limited to the amount you paid for the item at issue. Nothing in these Terms limits liability for personal injury, death, fraud, or willful misconduct (California Civil Code §1668).

Age requirement

Our products are intended for adults. By placing an order you affirm that you are at least 18 years old.

Dispute resolution & arbitration

You and New Era Nutrition agree that any dispute arising out of these Terms or your purchase will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court — except that either party may bring an individual claim in small claims court. You and we each waive any right to a jury trial and to participate in a class, collective, or representative action.

30-day opt-out: you may reject this arbitration agreement by emailing hello@neweranutrition.fitness with your name and "Arbitration Opt-Out" within 30 days of your first purchase. Opting out does not affect any other part of these Terms.

Governing law

These terms are governed by the laws of the State of California. Any dispute not subject to arbitration will be handled in the state or federal courts located in Kern County, California.
